1. Scope

These terms and conditions govern all orders placed on the online shop shop.swiss-hobby.ch, operated by SH4 Swiss Hobby Sàrl ("Swiss Hobby"). By ordering, the customer confirms having read and accepted these terms. The customer's own terms do not apply.

2. Offer and conclusion of contract

The products shown in the shop are an invitation to order, not a binding offer. The customer's order constitutes an offer to purchase. The contract is concluded when Swiss Hobby confirms dispatch of the goods (for pre-orders: expressly accepts the order).

The automatic order acknowledgement does not constitute acceptance. Swiss Hobby may decline an order without stating reasons, in particular in the event of an obvious pricing error or unavailability; any payment already made is refunded in full.

3. Prices

Prices are in Swiss francs (CHF), including 8.1 % Swiss VAT. The euro display is provided for convenience; the amount shown at the time of the order in the chosen currency is decisive. Shipping costs are shown before the order is confirmed and are added to the article price. Obvious errors remain reserved (art. 24 CO).

4. Pre-orders (novelties)

Articles announced by the manufacturers (Märklin, Trix, LGB, etc.) and not yet delivered may be pre-ordered. The pre-order is binding upon its acceptance by Swiss Hobby.

  • The delivery dates communicated by the manufacturers are indicative and do not bind Swiss Hobby; postponements by the manufacturer give no right to cancellation or compensation.
  • Swiss Hobby may request a 30 % deposit, in particular for pre-orders above CHF 500.—.
  • Cancellation of a pre-order is only possible with Swiss Hobby's written consent. If the customer withdraws from the contract, a flat compensation of 30 % of the order value is due; any deposit paid is applied to it and is not refunded.
  • If the manufacturer abandons production, the pre-order is cancelled and the deposit refunded in full. If the manufacturer raises its price by more than 5 % between pre-order and delivery, the customer may withdraw at no cost.

5. Payment

Payment is made using the methods offered at checkout. Goods are dispatched only after full receipt of payment, unless otherwise agreed in writing. In the event of default, interest of 5 % is due (art. 104 CO). The goods remain the property of Swiss Hobby until paid in full.

6. Delivery

Swiss Hobby delivers exclusively in Switzerland and Liechtenstein. Delivery times are indicative. Parcels travel at Swiss Hobby's risk until handed over to the customer. The customer inspects the goods on receipt; transport damage and apparent defects must be reported within 5 working days, keeping the packaging.

7. Returns

Swiss law provides no right of withdrawal for online purchases. Swiss Hobby nevertheless voluntarily offers the following:

  • articles may be returned within 10 days of receipt, with Swiss Hobby's prior agreement (request by e-mail with the order reference);
  • only unopened articles in intact original packaging, in perfectly resalable condition and with proof of purchase, are taken back;
  • the return is credited as store credit valid for 5 years — no cash refund;
  • handling fees may be deducted from the credit; an article returned opened, incomplete or marked is not taken back — or, with the customer's agreement, taken back as a pre-owned item at reduced value;
  • excluded from any return: pre-orders and special orders, spare parts, pre-owned items, unsealed media (CD, DVD, software) and gift cards;
  • returns sent without prior agreement create no entitlement and remain at the sender's cost and risk; return shipping is at the customer's expense.

The customer's statutory rights in the event of defects (sec. 8) remain reserved.

8. Warranty

New articles benefit from the statutory two-year warranty from delivery (art. 210 CO). In the event of a proven defect, Swiss Hobby first proceeds, at its choice, with repair or replacement; if neither is possible within a reasonable time, the customer may request a price reduction or rescission. Excluded are normal wear (pickup shoes, traction tyres, bulbs, motor brushes), damage from improper use, and modifications or interventions by the customer (in particular fitting decoders or parts not intended by the manufacturer).

Pre-owned articles are sold in the condition described; the warranty is reduced to one year (art. 210 par. 4 CO); wear described or visible in the photos is not a defect.

Any manufacturer warranties apply in addition, under their own conditions.

9. Nature of the products

The models sold are collector's items intended for adults and young people from 14 years; they are not toys and contain small parts. The manufacturers' age and safety indications prevail.

10. Liability

Swiss Hobby's liability for indirect and consequential damage is excluded to the extent permitted by law. Liability for gross negligence or intent and product liability remain reserved.

11. Data protection

The processing of personal data is described in the shop's privacy policy, which complies with the Swiss Federal Act on Data Protection (FADP).

12. Applicable law and jurisdiction

Swiss law applies, to the exclusion of the Vienna Sales Convention (CISG). The place of jurisdiction is Rolle (VD), subject to mandatory places of jurisdiction, in particular that of the consumer's domicile (art. 32 CPC).

13. Final provisions

Should any clause of these terms prove void, the validity of the others is not affected. Swiss Hobby may amend these terms at any time; the version in force at the time of the order applies.
